Welcome to the Flooring Xtra website. These terms and conditions govern the use of flooringxtra.co.nz, including visits to our site, purchases on our site, participation in our database and promotions. You can access our terms and conditions at any time from the link at the bottom of any page of the site. These terms and conditions are intended to help deliver an enjoyable yet fair user experience for our customers. These terms are issued by Flooring Xtra Licensing Limited (“Flooring Xtra’). The expressions “we”, “us” and “our” refer to Flooring Xtra. These terms and conditions were last updated 19^th October 2020.

About Us

This website is owned and operated by Flooring Xtra Licensing Limited. If you wish to contact us please

Each of our Flooring Xtra stores is individually owned and operated. When you make a purchase with one of our Flooring Xtra stores, you enter a contract with the local business operating that store. With every purchase you can enjoy the reassurance that your purchase supports your local store and the endlessly hard-working families behind it.

Purchases made through the Flooring Xtra website are a contract between client and FX Web Sales Limited, a wholly owned subsidiary of Flooring Xtra Licensing Limited (Flooring Xtra).

Acceptance of Terms & Conditions

The Terms and Conditions are the terms on which Flooring Xtra offers you access to the services (“services”) of the flooringxtra.co.nz website. By accessing and interacting with the website or using the Services, you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from accessing and browsing the website. Without limiting our other rights and remedies we may refuse to supply any product or service, and we may deny access to this website, to anyone who breaches these Terms.

Amendment of Terms & Conditions

Due to the ever changing commercial, technological and regulatory environment, these Terms & Conditions may be amended from time to time. Amendments will be posted here and will be effective immediately without notice. The updated version of these Terms will supersede all prior versions. At the top of this page you will find the last date of update.

Content

While we endeavour to ensure that information provided through the website is accurate and current, errors and omissions may occur. Flooring Xtra does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site. For example (but without limitation):

Prices and colours of products may change, and all products are subject to availability;

Variations to products may occur from time to time for various reasons (including changes in product specifications);

Description of products are summaries only (with further information available on request); and

Due to technical or human error, information may be recorded incorrectly or omitted.

We do not accept responsibility for any loss suffered as a result of reliance on the accuracy, adequacy, completeness or currency of information on this website.

Flooring Xtra reserves the right to make changes to the content on this site at any time and without notice.

Colours & Photography

Images are for illustrative purposes and may vary from that shown. Despite every effort to accurately display each product's colours on our website, they are intended as a guide only and actual colours may vary. The colours you see online will also depend on your screen display and settings, therefore, we cannot guarantee that your monitor's display of any image will accurately reflect the colour of the product. For this reason, we encourage you to view the product in person prior to making purchasing decisions.

Ordering Goods and Services from Flooring Xtra | General

When you place an order with us, you are making an offer to buy goods or services. An order is placed on our website via adding a product to the shopping cart and proceeding through our checkout process. The checkout process includes giving us delivery and other relevant details for your order, entering payment information and submitting your order.

Products displayed on the site shopping areas can be purchased using the secure online MasterCard, Visa, Genoapay and LayBuy transaction facilities. Customers can be confident that all of their details are protected by the latest security mechanisms and are used only for purposes of the transaction fulfilment.

You have the option to register as a member of flooringxtra.co.nz. Apart from the many subscriber benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you checkout.

We do not supply trade quantities and reserve the right to limit the number of an item customers can purchase in a single transaction.

We will send you an e-mail to confirm that we have received and accepted your order, which indicates that your order has been accepted and you may not cancel it.

We will take payment from you when we accept your order.

Cancelling orders, refunds and items on sale | Rugs & décor items only

We reserve the right to refuse to fill any orders that you may place based on incorrect information on the website, orders that we believe, solely by our own judgement, to be placed in bad faith or for commercial purposes, e.g. any kind of reseller or competitor. We also reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently.

While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.

Flooring Xtra reserves the right to withdraw any product from sale at any time without notice for any reason.

Our right to cancel orders applies to orders that have been accepted.

If we discover an error or we are unable to fulfil the order we will attempt to contact you and cancel the order and you will receive a full refund in the form of the original payment method. If your order is cancelled in accordance with these Terms, your payment will be refunded, crediting your original method of payment. If payment was made using a credit card that card issuer controls the timing of the refund.

Make sure that you are confident with your purchase selection, colour choice and that it is fit for purpose. If you change your mind, it is likely that we will be unable to cancel your order due to the nature of the product (ordered and picked/cut specifically for your project). If you wish to cancel your order you will need to contact the Flooring Xtra web team web.sales@flooringxta.co.nz to discuss your request with them. If we can cancel your order at our discretion, any associated freight, restocking and administration fees will be at your expense.

Any rug or home decor item on sale cannot be returned unless there is a manufacturing fault. Please choose carefully.

Returns will not be accepted unless the goods supplied do not meet our obligations under the Consumer Guarantees Act.

Refunds will be issued at the discretion of Flooring Xtra.

Exchanges | Rugs & décor items only

If you have changed your mind about a rug that you have purchased online and you want to return it for a refund, there will be a restocking fee of 5% of the purchase price as well as a freight cost to return the rug. The freight charge will be variable according to the size of the rug and your location. The restocking and freight return fee will be deducted from the total sum refunded back to you. Returns remain the responsibility of the purchaser until received by Flooring Xtra.

If you have purchased a rug online and wish to exchange it for another rug, there will be no restocking fee for your first rug exchange, however for any further exchanges for the same order you will be charged a restocking fee. For all rug exchanges there will be a freight charge to return the original rug. Returns remain the responsibility of the purchaser until received by Flooring Xtra. Any exchanges will be sent back to the purchaser for FREE.

We have 3 rules of returns and exchanges:

Item(s) must be returned within 7 days of delivery;
Item(s) must be unused and in new condition with any original tags and labelling still attached; and
Item(s) must be in their original packaging which must be in original condition. This includes all packaging, such as branded dust bags, branded plastic bags, unbranded bags, clear plastic and boxes.

If your item(s) matches all of these conditions, you can lodge a return or exchange. To request a return or exchange, please email websales@flooringxtra.co.nz with your order number and request.

Items purchased online cannot be returned to our physical stores.

Delivery | Rugs, floor care & décor items only

Title and risk in a product purchased from this website passes to you once we have received full payment for the product and the product has been dispatched from Flooring Xtra. Dispatch times may vary according to availability and we take no responsibility for any delays in delivery.

If any goods arrive damaged, please contact web.sales@flooringxtra.co.nz within 24 hours of delivery. The item will be collected, assessed and Flooring Xtra will arrange a repair, replace or refund the purchase price to you, at its election.

Currently products are not available for delivery outside of New Zealand. If you are interested in shipping items overseas, please contact websales@flooringxtra.co.nz. Any international purchases may be subject to import duties and taxes which are levied when the delivery reaches the specified designation. You will be responsible for payment of these duties and taxes.

Full terms and conditions for DIY flooring purchases

Flooring and flooring accessory purchases/orders from Flooring Xtra are considered ‘Special Orders’ due to it being ordered and/or cut specifically for your project.

Orders will incur a shipping/handling fee because of size, weight or special handling – this is required to make sure your order reaches your click and collect store safely.

Returns or exchanges on special orders will not be accepted unless the goods supplied do not meet our obligations under the Consumer Guarantees Act. Prior to purchasing, please make sure you’re confident with your product selection, ensuring it’s fit for purpose and you’re happy with your colour choice(s). We recommend that you order a sample or view a sample in-store to make sure that you are happy with your selection before placing your order.

Please ensure that you have ordered the correct amount of flooring and underlay that you require, any additions, or amendments will be subject to the minimum delivery charge due to freight costs once the order has been processed. The customer is solely responsible for ensuring accuracy of quantities are correct as ordering additional product for your project will be considered a new order and incur freight and handling fees.

If you change your mind, we will be unable to cancel/return/refund your order due to the nature of the product being a ‘Special Order’. Returns of unused packs, both open and closed will not be accepted.

Orders will be processed same day if received before 1pm Monday - Friday, excluding holidays. As a guide, delivery timeframes for your order to reach your click and collect store are as follows:

• Upper North Island 2-3 working days

• Lower North Island 3-4 working days

• South Island 4-5 working days

Collection of your order needs to be made from the selected ‘Click and Collect’ store within five working days of its arrival. You will receive an email notification with the tracking reference so that you can follow its delivery. Your ‘Click and Collect’ store will notify you when your delivery has arrived and they will organise a time for you to collect the delivery. The store will need to ensure that there is a store person available at the time for collection. If you do not collect your order within 5 working days then the returns process will be initiated.

Returns due to non-collection will incur all freight, restocking and handling fees. Collection of your order is your care and responsibility. You must ensure that you have suitable transportation available for your order, remembering that flooring is a large, heavy and bulky item. Please be prepared to lift this into your vehicle/trailer. Upon collection of your goods, you will sign having received these into your care.

Flooring Xtra does not warrant the installation of the products. We recommend that you or the person installing the flooring follows the manufacturer’s instructions and Flooring Installation Code (NZS AS 1884:2013) to ensure that your flooring is installed correctly. Incorrectly installed flooring voids the manufacturer’s warranty. Please revert to the correct installation instructions. Where the fault appears to lie within the product rather than incorrect preparation and installation, Flooring Xtra will fulfil its obligations under the Consumer Guarantees Act, which often starts with raising a claim for assessment with the manufacturer who is the warrantor of the product.

If you have any claims or concerns, these need to be sent to websales@flooringxtra.co.nz. The store in which you have chosen to ‘Click and Collect’ from cannot assist with returns, exchanges, cancellations or claims.

Website and Credit Card Security

We want you to have a safe and secure shopping experience online. All payments via our sites are processed using SSL (Secure Socket Layer) protocol, whereby sensitive information is encrypted to protect your privacy.You can help to protect your details from unauthorised access by logging out each time you finish using the site, particularly if you are doing so from a public or shared computer.

Pricing

All prices and delivery charges on our site are in New Zealand dollars (NZ$) and include New Zealand GST (if any). We reserve the right to alter prices and delivery charges for any reason at any time. If this should happen after you have placed an order, we will contact you prior to processing it.

Pricing on the website is displayed in square metres (sqm, m2, square m). Square metre pricing is shown to help compare the costs of different flooring types.

Pricing on the website may be displayed as a range (i.e. $25 - $35 per sqm). This is to give you an indicative budget to work to and a more definitive price can be attained from your local Flooring Xtra store. Pricing may vary from store to store based on regional variances. Online and in store pricing may differ.

Not all items or promotions are available through all stores, a specific store or online. All offers and items are subject to availability at the advertised price.

The minimum flooring purchase is one lineal metre or one pack.

All products and offers shown on this website are subject to availability and may not be available at all stores. We cannot guarantee that your chosen items will be in stock when you order from this website.

Contracts for the purchase of products using the Service, and any dispute or claim arising out of or in connection with them or their subject matter or formulation, will be governed by New Zealand law. Any such dispute or claim shall be subject to the non-exclusive jurisdiction of the New Zealand courts.

Discount Codes & Offers

We may from time to time offer limited promotional discount codes which may be used to purchase items on this website. The conditions of use relating to any discount code will be specified at the time of issue. Discount codes can only be used for online purchase, not redeemable in store unless otherwise specified.

All Flooring Xtra promotions and offers are for a limited time only and while stocks last. Flooring Xtra reserves the right to terminate, suspend or modify the promotion or offer without notice. All promotions and offers are non-transferable or redeemable for cash.

By participating in reviewing items and online content you represent and warrant that:
